A
High Court sitting in Ikirun, Osun State, on Tuesday discharged and
acquitted the Alowa of Ilowa Ijesa, Oba Adebukola Alli of rape
allegation leveled against him by a former member of the National Youth
Service Corps, Miss. Hellen Okpara.
Justice Oyejide Falola, while delivering
the final judgement in the case which was instituted about three years
ago, said that the plaintiff failed to prove beyond reasonable doubt
that the monarch raped her as she claimed.
The corps member, who served in Alli’s
domain between 2010 and 2011, had told the court that the monarch took
her to his private residence in Osogbo, the state capital where he
forcefully had sex with her.
But the monarch denied the claim saying the ex-corps member was his girl friend.
The judge, however, reprimanded the
monarch for stooping low to the extent of having sexual intercourse with
a lady serving in his domain. The judge said that Alli had denigrated
the royalty by his act and had brought ridicule upon himself, the throne
and the town.
Fallon stated that the shameful act of
the monarch was not punishable under the law and thereby ordered that
he should be discharged and acquitted.
He said, “The plaintiff failed to prove
beyond reasonable doubt that the defendant raped her. A case of rape
can be established with exhibits including medical report which
indicates forceful penetration but the prosecutor failed to tender all
these.”
