The
Save Nigeria Group on Monday instituted a legal action at the Federal
High Court in Lagos against the Federal Government on the withdrawal of
N2.5tn for subsidy payments from the Consolidated Revenue Fund instead
of the N245bn approved in the 2011 Appropriation Act.
SNG Convener, Pastor Tunde Bakare, said this at a press conference in Lagos on Monday.
Bakare lamented that President Goodluck Jonathan had
not directly addressed the matter ‘‘except through remarks on his behalf
by presidential aides.’’
In the Originating Summons, the Plaintiff asked the
court, among other things, to determine whether, ‘‘Having regard to the
provisions of Sections 80(2) (3) & 81(1) & (2) of the
Constitution of the Federal Republic of Nigeria, 1999 (as amended),
whether the President of the Federal Republic of Nigeria or any other
person acting on his instructions can lawfully withdraw and expend
monies from the Consolidation Revenue Fund or any other public funds of
the Federation without authorisation by an Appropriation Act,
Supplementary Appropriation Act or any Act of the National Assembly.’’
Bakare stated that the group was ready to give “reasonable time” before its planned protests on the subsidy fraud.
He said, “We are ready to extend the rope to see what
comes out of the Economic and Financial Crimes Commission’s promise
within a reasonable time.”
